Terms and Conditions
General Terms and Conditions and Information about our Delivery Service

1) General Conditions
1a. All products as shown on this website (as may be varied from time to time) are available almost everywhere in our delivery area.
1b. All products are subject to availability. In the event of any supply difficulties, we reserve the right to substitute with a product of equivalent value and quality without notice.
1c. In the event that we are unable to supply all or part of your order (the product or any substitute product to you at all), we shall notify you as soon as possible and reimburse your payment in full.

2) Flowers and Floral Gifts
2a. Certain flower and plant products may be delivered in bud to ensure longer life.
2b. Colours and shades and variety of flowers pictured may change with different seasons, so the images shown should be used as a guide.

3) Prices
3a. All prices shown include VAT - once your have placed your order a VAT receipt can be printed from our Customer Services Area.
3b. Except where stated product prices exclude delivery charge.

4) Orders / Payment
4a. As part of order process you will be required to provide us with your complete personal details, including accurate postcode, together with those of the intended recipient and all necessary payment details.
4b. We accept payment by all major credit and/or debit cards including American Express and Diners Card, and other credit and/or debit cards as we may specify from time to time.
4c. By clicking on the 'check out' button at the end of the order process, you are consenting to be bound by these Terms and Conditions.
4d. Submitting your order is subject our acceptance of this. We will send an email confirmation of your order details to advise that we are processing your order via the email address you provide. We will not consider ourselves bound by a contract with you until we have issued this email confirmation.
4e. We cannot accept orders from customers under the age of eighteen (18) years.

5) Champagne, Wines and Spirits
5a. Under the Licensing Act of 1964 (UK) and 1976 (Scotland) it is an offence for any person under 18 years to buy, or attempt to buy, alcoholic liquor. It is an offence under Sections 32 and 33 of the Intoxicating Liquor Act 1988 (Ireland) for any person under 18 to buy, or attempt to buy, intoxicating liquor. It is an offence under Licensing (Northern Ireland) Order 1990 for any person under 18 to buy, or attempt to buy, intoxicating liquor.
5b. Due to licencing restrictions, collections of alcohol can only be collected from our Nottingham shop.

6) Delivery and Delivery Charges
6a. Except where stated, we will deliver on the day specified on your order. The delivery will be made anytime during the the 'normal working day', and where the delivery address shows a workplace address, we will endeavour to deliver during normal office hours.

6b. Deliveries for our standard "Same Day" delivery service must be received by us before 2.00pm on the day of delivery.
6c. Should you require your delivery to be made within a specific time period we are able to offer our "Express Delivery" service across the majority of our delivery area. Where available, an option for our 'Express Delivery' service will be shown on your order form, together with the appropriate charge. A "3 Hour" time gap is required and deliveries at a specific time cannot be catered for via the website.
6d. The delivery charge levied will vary, and is calculated by postcode area - please ensure that you have the correct postcode for the recipient order order for the appropriate charge to be made by the system. If you are unsure of the postcode area, please refer to our delivery area page for assistance.
6e. During very busy times, or certain Express Deliveries, we reserve the right to use a third party delivery service where timing of your delivery is a priority.
6f. Guaranteed AM or PM deliveries will be charged in accordance with 6e above, and would ask you to choose the most appropriate time slot available.
6g. Your requested delivery date will be re-confirmed in your email order confirmation. We will process orders received on Sundays or Public Holidays the next working day.
6h. Delivery is not usually available on Sundays or public holidays - The exception to this will be where one of our peak delivery times falls on a weekend. (e.g Christmas Eve, Valentine's Day, Mother's Day etc etc) - all other orders for delivery on a Sunday will be delivered on the next working day.
6i. To avoid problems or delays with delivery, please ensure that you have included the full address details, including accurate postcode of the intended recipient and telephone number, together with your daytime contact telephone number or e-mail address so that we can notify you in the event that any delivery problems are encountered.
6j. Whilst we agree to use all reasonable endeavours to ensure that delivery will be on the requested delivery date, you acknowledge that in very occasional circumstances delivery on the requested terms may not be possible, in such circumstances you will be given prior notice wherever possible and we shall either make alternative arrangements or reimburse your payment in full in accordance with clause 1.5 above.
6k. In the case of delivery to certain locations, where a third party is involved, such as offices, hospitals, Funeral Directors, airports, hotels, ships and other business locations, the signature of any person authorised to accept delivery on behalf of the organisation shall be accepted as proof of delivery to your chosen recipient. Please be advised that some products are unsuitable for delivery to Funeral Directors, Hospitals, airports or ships – please contact us for further information.
6l. Please note that we are only responsible for delivering to the address you specify on your order form (or to a neighbour if no one is at home) we regret that where the goods have been correctly delivered we cannot accept responsibility if the intended recipient has moved, or lives elsewhere, and the actual receiver refuses or fails to return item(s).
6m. Where we are unable to find someone to accept delivery we will either deliver to a neighbour and/or leave a card at the address for the recipient to make contact to arrange re-delivery. Such a re-delivery may not be possible on the same day, and we reserve the right to levy a further delivery charge should multiple attempts be made to deliver your item.
6n. In the instance of there being difficulties in delivering your order to the intended recipient we (including the florist or third party delivering your order) reserve the right to contact the recipient using the contact details you provide at the time of placing your order.

7) Cancellation of your Order
7a. Orders may be amended or cancelled up to 2 working days before the intended delivery date.
7b. To amend or cancel your order, please contact our Customer Services Team using the contact details shown on our website.
7c. If you buy goods or services over the internet, by mail order or catalogue, digital television, phone or fax, you are protected by the Consumer Protection (Distance Selling) Regulations 2000 which grant you a cooling-off period of seven working days after agreeing to the purchase during which you can cancel the agreement. We must give you clear prior information about the goods or services, including:
  • A clear description of the goods or services,
  • Our contact details
  • Details of cost and payment, including taxes
  • Delivery arrangements, or date for service to be carried out
  • Cancellation rights
    You must be also given written confirmation of the order which must include all of the information listed above.

    We must point our that personalised goods or items made to a consumer's specification, perishable goods (flowers, fresh foods etc) are excluded from the Consumer Protection (Distance Selling) Regulations.

    8) Customer Services
    8a. In the unlikely event that you are not satisfied with our service, any complaints should be addressed in the first instance to our Customer Services Team, using the contact details available from our website.
    8b. Because of the perishable nature of most of our products, and in order to assist us in resolving any complaints quickly and to our mutual satisfaction, we advise you to make any complaint within 1 or 2 workings day of the date of delivery. Any complaints outside of this timescale may not honoured.
    8c. The majority of calls we received relate to poor housekeeping and lack of care of your floral gift. With your flowers, either as a separate care card or on the reversed of your message card, will be your care instruction. Before your contact us please ensure that you have followed the care instruction provided, or refer to our care pages of this website

    8d. Upon receipt of your complaint, we reserve the right to collect the goods back within a reasonable timeframe of receipt of your complaint - should the goods not be available for return in the same condition as delivered, then you forfeit your rights under these terms and conditions of a refund.

    9) Disclaimer
    9a. Whilst we agree to use all reasonable endeavours to ensure that this website is fully operational and error-free we cannot guarantee this and, therefore, accept no responsibility for any defects and/or interruption of the site and shall be released from our obligations under these Terms and Conditions in the event of any cause beyond our reasonable control which renders the provision of the website impossible or impractical.
    9b We shall not be liable for any delay or inability to perform our obligations to you if such delay is due to any cause whatsoever beyond our reasonable control.

    10) General
    9a. Whilst we agree to use all reasonable endeavours to ensure that this website is fully operational and error-free we cannot guarantee this and, therefore, accept no responsibility for any defects and/or interruption of the site and shall be released from our obligations under these Terms and Conditions in the event of any cause beyond our reasonable control which renders the provision of the website impossible or impractical.
    9b. We reserve the right to supplement and amend the Terms and Conditions on which you are permitted access to this website from time to time. We will post any changes on the website and it is your responsibility as a customer to review the Terms and Conditions on each occasion you access the the site. Changes will be effective five (5) hours after the posting of any such change and all subsequent dealings between you and us shall be on the new terms and conditions.
    9c. Additionally, we reserve the right to suspend, restrict or terminate access to the site our any of our services for any reason at any time.
    9d. These Terms and Conditions shall be deemed to include all other notices, policies, disclaimers and other terms contained on the site, provided that in the event of a conflict between any such other notices, policies, disclaimers and other terms, these Terms and Conditions shall prevail. If any of these Terms and Conditions is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
    9e. We shall ensure that we comply with the requirement of all current data protection legislation including, without limitation, the Data Protection Act 1998 (as replaced, modified or re-enacted from time to time). We shall only use personal data received from you for the purpose of fulfilling our obligations under these Terms and Conditions
    9f. A person who is not a party to the agreement between you and us has no rights under the Contracts (Rights of Third Parties) Act 1999 to enforce any of the Terms and Conditions but this does not affect any right or remedy which exists apart from that Act.
    9g. In respect of fraudulent misrepresentation, this agreement (including any documents and instruments referred to herein) supersedes all prior representations, arrangements, understandings, and agreements between you and us (whether written or oral) and sets forth the entire agreement and understanding between you and us relating to the subject matter hereof.
    9h. Your purchase will be deemed to have occurred in the UK. These Terms and Conditions shall be governed by and construed in accordance with English Law and the parties agree to submit to the exclusive jurisdiction of the English courts.

    11a. All other rights, including copyright, in this website are owned by A. A. Anderson's of Nottingham Limited. Any use of this website or its contents, including copying or storing it or them in whole or part, other than for your own personal, non commercial use is prohibited without the permission of A. A. Anderson's of Nottingham Limited. You may not modify, distribute or repost something on this website for any purpose.
    11b Certain images contained on this site remain copyright of their respective owners, and are used by agreement with those parties concern.

    12) Customer Services/Order History/Privacy Statement
    12a. Your order history service is provided as a complimentary feature for your personal use and is subject to these Terms and Conditions. In order to provide the Service, we will hold certain personal information that you have provided on your order form. Except to the extent that we are required or permitted by law, any personal information which we collect will be used solely for the purposes of providing the Service.
    12b. To register with the Service you must be over eighteen years of age.
    12c. When you place your first order you will be granted automatic access to the service, and a password will be randomly generated and forwarded to you by email. You must keep this password confidential and must not disclose it or share it with anyone. You will be responsible for all activities and orders that occur or are submitted under your password. If you know or suspect that someone else knows your password you should notify us immediately. Should you forget your password, please use the password reminder service which can be found by using the log in here button on the navigation bar.
    12d. If we have reason to believe that there is likely to be a breach of security or misuse of the Service or site, we may require you to change your password, or may suspend use of the Service.
    12e. You must ensure that the details you provide on registration or at any time are correct and complete.
    12f. You must inform us immediately of any changes to the information that you provided when registering by updating your personal details. You can update the details you have given us at any time by changing your details on your next order. This will ensure that the Service we provide is accurate and up to date. You can always email us if any of the information that we hold about you is incorrect or needs updating, or if you want us to delete any personal information.
    12g. Use of the Service is intended to assist with purchases you have made via the site. The Service must not be used for:-
  • Disseminating any unlawful, harassing, libellous, abusive, threatening, harmful, vulgar, obscene, or otherwise objectionable material
  • Gaining unauthorised access to other computer systems.
  • Interfering with any other person's use or enjoyment of the Site.
    12f. We reserve the right to refuse to post material on the Site, or to remove material already posted on the Site.

Whilst we take every reasonable precaution and care in relation to the Service, we do not make any representation or warranties of any kind (express or implied) with respect to the contents or operation of this Service, and any such representations and warranties are excluded by this notice. We do not warrant that use of the Service will be uninterrupted or error free. Whilst every effort is made to ensure reminder emails set up on your account are processed and delivered as requested, we cannot be held responsible for non-delivery of these messages. Your use of the Service is done so entirely at your own risk and we do not accept any liability whatsoever for losses or damages that you may suffer as a result of your use of the Service.
    12h. Your access to the Site and Service may be occasionally restricted to allow for routine maintenance.

You have the right to Unsubscribe from this at any time, and you will be given the opportunity be removed from this database.
